A Logan man’s unbelievable excuse for drink driving when he wasn’t supposed to has been revealed in court, where he laughingly told a magistrate his reason for breaking the law.
Brandon Leigh McKenzie, 27, pleaded guilty in Beenleigh Magistrates Court on February 1 to one count of driving while over the no alcohol limit but not over the general limit and without a licence.
McKenzie was self represented in court and said he was remorseful for his behaviour and realised how silly his drinking was.
“It was irresponsible and a bad idea to have tequila for breakfast,” he told Magistrate Ron Kilner while laughing.
“I hadn’t had a phone for two weeks either so I didn’t know my licence was SPER suspended.”
The court heard on December 23, 2023 McKenzie was in a three-car crash on Kingston Rd, Loganlea and breathalysed at the scene.
He blew a blood alcohol limit of 0.026 per cent and his licence was suspended.
He was also convicted of drink driving in 2021 where he returned a blood alcohol concentration of 0.144 per cent.
Magistrate Kilner said the Kuraby man’s behaviour was concerning.
“You’ve got a problem haven’t you. You have got to have a zero reading if driving without a licence.
“I take into account your personal circumstances, remorse and early plea of guilty when handing down a sentence.”
McKenzie was fined $250 and disqualified from holding a licence for three months.
A conviction was recorded.
