Clinton Christopher Baldwin, 39, pleaded guilty in the Beenleigh District court on November 2 to two counts of assault occasioning bodily harm, one count of entering a dwelling with intent in company, one count of grievous bodily harm, two counts of stealing and two counts of wilful damage.

Co-accused, Theodore Jason Hinana Soloman, 31, pleaded guilty in the same proceeding to two counts of assault occasioning bodily harm, one count of entering a dwelling with intent in company, one count of grievous bodily harm, one count of stealing and wilful damage.

The court heard both men were allegedly a part of a bikie group called Highway 61.

Baldwin, Soloman and two others went to a Jimboomba home on October 1, 2018 after Baldwin sent threatening messages over Facebook to the victim, the court was told.

“They entered a home wearing hoods with their faces concealed,” the crown prosecutor said.

“They entered the bedroom and commenced assaulting (the victim) while he was asleep on his bed.

“The victim was held down by one of them and lost consciousness during the repeated assault on him.

“His wife attempted to intervene but she was assaulted.”

The victim’s son was in a nearby room playing games on his Xbox console when a third accused assaulted him, the court heard.

“It was a continuous assault, it was vicious and cowardly,” the crown prosecutor said.

“It was planned and co-ordinated and was motivated through the club.”

The four men left yelling ‘we are Highway 61’, the court heard.

Baldwin’s lawyer, Wayne Tolton, said his client made a stupid decision to initiate the attack.

“He has no history whatsoever of violence,” Mr Tolton said.

“He was enjoying a pleasant day on his own drinking loads of alcohol, he was highly intoxicated.

“It was due to his stupidity, his intoxication that led him to that.

“Since then he has immediately disassociated himself from the group.

“It’s a Sunday BBQ club rather than a criminal organisation.”

Judge Craig Chowdhury said the attack started because of owed money.

“Apparently he was struggling financially and owed $4000 to the gang,” Mr Chowdhury said.

Mr Chowdhury said the facts of the attack were alarming.

“She heard her son yell out, she saw Soloman and another punching her husband's head and stomach,” Mr Chowdhury said.

“She screamed at you to stop, she threw herself over her husband to try to protect him.

“He could taste blood in his mouth and then he lost consciousness.

“He had trouble walking and saw blood everywhere.”

Mr Chowdhury warned both men of the consequences of their actions.

“People can’t take the law into their own hands,” he said.

“You could have easily killed him, Mr Soloman.”

Both men were convicted and received a head sentence of five years, suspended after serving 14 months for an operational period of five years.
