A southeast Queensland Australia Post delivery driver bashed a 44-year-old woman in her own backyard and tore her shoulder ligament after arriving at 3am claiming he could hear music.

A drunk off-duty Logan postman bashed a 44-year-old woman in her own backyard, tearing her shoulder ligament, after claiming he could hear music coming from her home and wanted to come party.

Logan Central resident Andrew Opu Maino, 34, a delivery driver with Australia Post, was charged with trespass and assault occasioning bodily harm following the April 4 incident.

The court heard about 3am that morning, Logan Central woman Sharee Nicole Lister, 44, heard suspicious noises in her backyard.

When she went to investigate, she witnessed Maino, who was not known to her, standing in her backyard.

She asked why he was there to which he responded he could “hear music and thought there was a party”, the court heard.

Mrs Lister called out to her husband for assistance and the pair attempted to get the very intoxicated Maino off their property.

A physical altercation ensued, with Mrs Lister being struck twice in the face, once to the mouth and once to her left cheek.

It was subsequently discovered when she attended hospital Mrs Lister had torn a ligament in her shoulder which would require surgery.

Maino was eventually restrained with the assistance of neighbours and police were called.

Police prosecutor Snr Const Michael Read told the court Mrs Lister was expected to make a full recovery in 10 – 12 months but the assault had “serious” long-term consequences her.

The court heard she was a kinship carer for two young boys but was forced to give them up due to the injuries she sustained in the assault.

Defence counsel Jason Todman told the court his client was married with a two-year-old son.

“He drank too much and went to the wrong backyard,” Mr Todman said.

Magistrate Clare Kelly said it was an “ugly incident”.

“Almost every aspect of her life has been impacted,” she said.

“She fears an assault at any time.”

Maino pleaded guilty to trespass and assault occasioning bodily harm.

He was sentenced to 12 months’ imprisonment with immediate court-ordered parole.

He was also ordered to pay Mrs Lister $1000 compensation.
