A TOWNSVILLE magistrate has gone head to head in court with a Legal Aid lawyer after the lawyer suggested police were lying about a woman’s injuries sustained in an alleged domestic violence incident.
Nick Douglas made a bail application for his client who cannot be named for legal reasons in the Townsville Magistrates Court on Wednesday.
The man is charged with contravening a domestic violence order and a number of other offences.
Prosecutor Cassandra Nitz told the court a woman suffered serious injuries as a result of the man allegedly punching her in the face with a closed fist and closing a car bonnet on her head.
Ms Nitz said police “observed blood streaming from a large gash above her eye and swelling all over her face”.
Mr Douglas told Magistrate Viviana Keegan he asked police for a photograph of the woman’s alleged injuries however “none have been forthcoming”.
Ms Keegan questioned Mr Douglas asking him if he suggested the police were lying.
Mr Douglas replied and said “that’s the submission”.
Ms Keegan told Mr Douglas to list the matter for trial and “put police in the witness box and put to them they’re lying”.
Ms Keegan refused the man’s bail application and listed the matter for further mention on Monday.
