A TOWNSVILLE man who was granted bail after threatening to kill his partner and her children last week has now been refused bail after being taken back into custody.
The 27-year-old man who cannot be named fronted the Townsville Magistrates Court last Thursday charged with one count of contravening a domestic violence order.
The court heard the man made threats to kill his partner and her children by burning their house down while they were inside.
Last week, Magistrate Steven Mosch granted bail despite the prosecution arguing there was an “unacceptable risk” to the alleged victim and her family as no information a fire occurred was presented.
The man again appeared in court on Tuesday after it was revealed there had in fact been a fire at a house associated with the aggrieved.
A warrant was executed for the man’s arrest and he was taken back into custody 90 minutes after initially being released.
When considering the man’s bail application on Tuesday, Mr Mosch said he was simply considering it based on a charge of contravention of a domestic violence order as no charge of arson had been laid.
Police Prosecutor Acting Senior Sergeant John Moran again strongly opposed bail and said police were still investigating the cause of the fire.
Mr Mosch said the revelation a fire had actually occurred put the charge in a “totally different circumstance” and refused the man’s bail application.
The charge was adjourned to June 11.
