A man walking along a busy Townsville road was mauled by a dog right before its owner’s eyes, just nine days after she had appealed to revoke its dangerous dog declaration.

A MAN walking along a busy Townsville street was mauled by a dog right before its owner’s eyes, just nine days after she appealed to revoke the animal’s dangerous dog declaration.

Megan Lisa Murray pleaded guilty in Townsville Magistrates Court on Tuesday to two charges of relevant person must ensure dog does not attack or cause fear.

The court heard that on June 13, 2021, Murray’s bull mastiff, Cherry Biscuit, had run out of Murray’s open gate and bit a 56-year-old woman on the buttocks as she walked by the property on Ross River Rd.

The bite broke through the woman’s skin and caused “extensive bruising”.

It was heard Murray had given the woman first-aid on the scene after the attack.

That attack resulted in Townsville City Council issuing a dangerous dog declaration to Murray in July.

The declaration came with several conditions, including that Cherry Biscuit must wear a muzzle if it was outside of the fenced yard.

Murray challenged it on August 20 – an application that was not accepted.

Nine days later, the second attack occurred.

Murray and another man were walking Cherry Biscuit on Ross River Rd, with the dog not wearing its muzzle.

A man crossed their path and with no provocation, Cherry Biscuit leapt at the man and bit him on the arm.

Prosecution submitted the second incident was more serious.

“(She) seriously failed to comply with the regulations of keeping a dangerous dog,” the prosecutor said.

Murray told Magistrate Ross Mack that she was “deeply remorseful” and that the dog had since been stolen.

“I thought she was with somebody else,” Murray said.

Mr Mack said people were entitled to walk along streets in Townsville and not be bitten by dogs.

“It mauled the guy, he was bitten a lot of times,” Mr Mack said.

Murray was fined a total of $3640, with no conviction recorded.
