Magistrate said car wasn’t the only thing to overheat in brawl

A brawl in the middle of a street caused by a car overheating has led a magistrate to claim it wasn’t the only thing with a raised temperature on the night.

A TOWNSVILLE magistrate has told a man his car wasn’t the only thing that overheated when an argument between two mates turned into a brawl on a Kirwan street.

Ashliegh Troy Leslie James, 19, pleaded guilty in the Townsville Magistrates Court on Thursday to one charge of committing public nuisance.

Police prosecutor Jordan Theed said police were called to a street in Kirwan at 9.30pm on May 22 to respond to a physical altercation involving eight people.

Mr Theed said members of the public called police after a man was being “punched on the ground”.

Police separated everyone and questioned James who was “intoxicated” and had scratches to the upper right of his chest, Mr Theed said.

He said James made admissions to being involved in a fight with his friend on the street after the vehicle they were driving overheated and he took a look at its engine.

James had nothing to say about the incident when he represented himself in court.

In sentencing, Magistrate Steven Mosch said: “This motor vehicle was not the only item that overheated on this occasion.”

He fined James $500 for the “spectacle”. The fine was referred to SPER.

A conviction was not recorded.
