A jilted man tied a woman’s wrists with a dress tie and proceeded to inflict a violent, horrifying assault on her – less than three months after he was released from prison.
Jessey David had been with the woman since 2020 and started the relationship while he was still inside jail, crown prosecutor Andrew Walklate said.
The now 27-year-old, appeared in Townsville District Court by video link as he was arrested after violently stalking and harassing the woman he had been dating.
Mr Walklate told the court the woman had tried to end the relationship at the end of a weeks-long tirade from the man and when she called it off he locked the bedroom door and turned on loud music before slapping her so hard she fell back.
“He stands over her, she covers her face and he keeps yelling … he was putting a dress tie around her wrists,” the crown said.
“He put his hands around her neck and said ‘are you going to forget about the break up?’
“He keeps pressure on her neck.”
Mr Walklate labelled the offending, “disturbing”.
To de-escalate the situation the woman agreed to forget about the break up until later in the day where she messaged and confirmed that it was over, and he wrote back threatening to end his life and called her a “useless hoe”.
Before the woman ended the relationship, the pair had been driving when it came close to the man’s probation curfew and he accused her of trying to send him back to jail.
“He pulled her hair, she put her hands up, he grabbed her by the throat for 10 seconds,” Mr Walklate said.
He demanded the keys for her house and “dragged” her up the driveway and into the bedroom blocking her from being able to leave.
“He messages her and blames her for his emotional reaction and she says she doesn’t want anything to do with him,” the crown told the court.
The following day the woman was watching a movie at home when he appeared in her bedroom unexpectedly because she hadn’t been picking up his phone calls, which was followed by a series of abusive messages such as “f — king sl-t” and “selfish, cold, evil sl-t”.
The court was also told David tried to pressure the woman into dropping the charges by contacting his family members from inside prison to talk to her.
Mr Walklate said he was not long into the suspended sentence when he committed a violent robbery and was sentenced to five years, six months jail.
“He was out two and a half months before he offended again in a pretty horrendous way,” the crown said.
Defence barrister Ross Malcomson didn’t dive into the man’s personal history as it had already been placed on the record in the man’s last sentence.
“He’s still a young man, that is not an insignificant period of custody,” he said referring to the 938 days David had been in jail for since 2020.
He also told the court he had returned to methamphetamine use at the time of the domestic violence offence.
‘ … you weren’t taking no for an answer’ – Judge Richards
Judge Deborah Richards said the nine days of offending were “disturbing, quite violent and forceful”.
“In circumstances where she just wanted to be rid of you and you weren’t taking no for an answer.”
David pleaded guilty to deprivation of liberty, stalking with violence, common assault and attempting to pervert the course of justice.
He was sentenced to two years jail.
Her Honour said it was “hard” to give a sentence that properly reflected the man’s offences, as he was still serving jail for the previous sentence and no time would be declared as already served.
He was given an immediate parole eligibility date.
“If you get parole, you’re going to be on parole for a long time, which you should be,” she said.
