Zac Lee Pescud sentenced in Toowoomba District Court for glassing at man at the Shamrock Hotel during an altercation

A man’s night out with his girlfriend ended with his throat slashed in multiple places after he was the victim of a violent assault. His attacker has now faced court, and learnt his fate for the vicious incident.

A 39-year-old man who “glassed” a 25-year-old man at a Toowoomba CBD pub leaving him bleeding from a slashed throat has been jailed for two and a half years.

Zac Lee Pescud had been out with workmates at the Shamrock Hotel on the night of January 29, Toowoomba District Court heard.

Also there was the 25-year-old complainant and his partner who were enjoying a night out, Crown prosecutor Emily Coley told the court.

About midnight, the complainant and his partner were in the smoking section as was Pescud but as they re-entered the bar area the two men exchanged some words.

Pescud then erupted, throwing a flurry of punches, initially from behind the complainant, and then when he fell back against a wall a series of strikes from the front, she said.

At the time, Pescud had a glass in his hand which smashed and slashed the victim’s neck in a number of places, Ms Coley said.

Hotel CCTV footage of the incident was played to the court.

While Pescud left the hotel straight after, another patron took off his shirt to apply to the victim’s neck in an attempt to stem the flow of blood before he was taken to Toowoomba Hospital.

Ms Coley said the victim underwent surgery to clean the wound and insert stitches, she said.

“Fortunately, he has healed quite well,” Ms Coley told the court.

With the victim and his partner watching on from the public gallery, Pescud pleaded guilty to one count of wounding, after the initial charge of grievous bodily harm was withdrawn by the Crown.

Pescud’s barrister Steve Kissick told the court his client had read the victim impact statements from the complainant and his girlfriend and he was “very remorseful” and acknowledged the harm he had caused.

Ms Coley said Pescud had no previous convictions of violence but he had been sentenced to six years in jail some years ago for trafficking meth.

Judge Bernard Porter sentenced Pescud to 30 months in jail but, declaring the 311 days he had served in custody since the incident as time served under the sentence, ordered he be released on parole immediately.
