A woman accused her ex-partner of choking her to the point of suffocation, while he claimed she had threatened revenge following the break up of their relationship, a court has heard.
Toowoomba man Tyrone James Pascoe, 29, appeared from Toowoomba watch-house before Toowoomba Magistrates Court on December 26 accused of a brutal attack on his ex-partner.
The court heard Mr Pascoe allegedly fought with his ex-partner on December 16 before forcing her into a chokehold and constricting his grip.
In a statement to police provided to the court, the woman claimed she could not breathe and when she asked Mr Pascoe to stop he replied, “say goodnight”.
Mr Pascoe also allegedly slammed the woman’s head against the wall and pushed a phone in her face in an attempt to unlock it.
A medical assessment completed the following day allegedly confirmed the woman had suffered a concussion.
Duty lawyer Claire Graham said Mr Pascoe advised her the woman had left messages threatening to interfere with her client’s probation order before the alleged attack.
“She sent numerous messages to my client indicating, and I’m paraphrasing, that essentially she will do anything she can to “f**k” my client’s probation order and telling him to do things such as go kill himself,” Ms Graham said.
“She arrived unannounced at my client’s address (on December 16), she verbally abused my client’s brother, made threats to my client’s brother to damage my client’s probation.
“He denies there having been any contact even between them on December 16 and certainly denies any physical violence towards her.”
When pressed by the magistrate, Ms Graham advised she herself was yet to cite the alleged messages as police had seized her client’s phone before she had the chance to do so.
Ms Graham also questioned aspects of the woman’s statement and lamented a trial would likely mean long delays in Mr Pascoe’s case.
“She says is unable to breathe yet she’s still been able to indicate to the defendant to stop, so there are some issues,” she said.
“He would be very, very lucky to get a trial in 2025.”
Police prosecutor Nick Pratt argued, alongside the alleged evidence of the crown case, there was a possible risk of fleeing and reoffending due to Mr Pascoe’s criminal history.
“It’s not just a risk of further offending and anti-social behaviour but also a risk of failing to appear,” he said.
“There is a history going back to 2016 of bad behaviour with respect to women … the fact that he has family in the Northern Territory suggests he is a flight risk.”
Acting magistrate Robert Turra refused bail on the basis Mr Pascoe had not shown cause his detention was unjust.
“Notwithstanding what the defendant says, but the facts before the court don’t necessarily play out his version.”
“I have to take the prosecution’s case at its highest.”
Mr Pascoe was remanded in custody and will return to court on February 12, 2025.
