A case involving two Fraser Coast men accused of torture has been adjourned awaiting submissions from the defence.
Wade Robert Burton and Benjamin Paul Diete are both charged with torture, deprivation of liberty and eight counts of occasioning bodily harm in relation to an incident in March of this year.
It is alleged the pair commited a protracted assault at a North Maclagan cattle property on March 4, which is about an hour’s drive northwest of Toowoomba, on the outskirts of the Western Downs near the Bunya Mountains.
Police allege the fencers tortured and assaulted the complainant with weapons, which included a ratchet strap used as a noose around the man’s neck, as well as a chain.
The pair had their case briefly mentioned in Toowoomba Magistrates Court on Thursday morning.
Solicitor Nathan Bouchier was in attendance for Mr Diete and acted as agent for Guest Lawyers on behalf of Mr Burton.
Neither of the alleged co-offenders appeared in court.
Mr Bouchier asked the magistrate to adjourn the case for six weeks, allowing both himself and Mr Burton’s council to submit applications for consideration with the prosecution, namely a cross examination application.
Magistrate Kyna Morice granted the adjournment and set a new date for August 15, 2024 at the Toowoomba Magistrates Court.
Both men will remain on bail while until this date.
