Three teenagers charged in relation to the stabbing of an 18-year-old homeless man in Toowoomba’s CBD had varying degrees of success when applying for bail in the city’s Magistrates Court.

Oakey pair Mullenjarly Pitt, 18, and Byron Fraser, 19, and a 14-year-old juvenile who cannot be named, have each been charged with unlawful wounding, possessing a knife in a public place and attempted armed robbery in company arising from the incident in Chronicle Lane beside the Neil Street Bus Terminal about 7.15pm Thursday.

Police claim the trio were captured on CitySafe camera near Grand Central earlier in the night posing for social media photographs with a hunting knife.

It is alleged Mr Pitt knew the complainant man and the group had discussed fighting or scaring him before they came across him in Chronicle Lane where an altercation took place, during which the complainant sustained a deep stab wound to his right upper chest.

Mr Pitt appeared via video link from the watch house to hear his solicitor Chelsea Saldumbide apply for bail on his behalf.

Ms Saldumbide said her client had no criminal history at all and lived with his foster family in Oakey.

However, magistrate Kay Phillipson noted in the police written objection to bail Pitt had made some admissions and told police he had scuffled with the complainant, who got him in a headlock and hit him with a can.

Mr Pitt told police he had then punched the man and he believed he had the hunting knife in his hand at the time, she said.

Ms Phillipson refused bail and remanded Mr Pitt in custody with his case next to be mentioned in the same court on April 14.

Solicitor Brad Skuse, for Byron Fraser, told the court his client had no criminal history at all, lived with his family in Oakey and was working at the town’s abattoir.

His client instructed he was actually trying to break up the scuffle, though police prosecutor Sergeant Tim Hutton said police didn’t accept that and by CCTV footage of the incident it appeared all three accused were involved.

Ms Phillipson said it appeared Fraser’s involvement was “significantly less than the other two people involved”.

Fraser was granted bail with strict conditions including living with his family in Oakey, abiding by a nightly curfew from 7pm to 5am, reporting to Oakey Police every Monday and Friday and having no contact at all with the complainant or his two co-accused.

His case was adjourned to April 14.

The 14-year-old boy appeared before Toowoomba Children’s Court and was granted bail to appear back in that court next month.
