An outstanding ballistics report has been blamed for delaying a high profile Toowoomba murder case.

Lachlan Mark Freund, 24, has been charged with murder arising from the shooting death of Thor Morgan who was shot while driving on Ruthven Street north in the early hours of March 15, 2022.

Mr Morgan, 25, was taken to a Brisbane hospital where he lay in a coma with a bullet in his brain for some weeks before eventually regaining consciousness.

However, he died on May 16, 2022.

Freund has not as yet been required to enter any pleas to the charges of murder, arson of a motor vehicle and unlawful use of a motor vehicle arising from the incident.

He was not required to be in Toowoomba Magistrates Court on Friday when the case was mentioned but was represented by solicitor Claire Graham acting as town agent for Freund’s legal team of Phillips Crawford Lawyers.

Police prosecutor Sergeant Julia Wheaton told the court the doctor’s report and other material had been disclosed to the defence this week but the ballistics report was still outstanding.

Sergeant Wheaton said she had been told the ballistics report could be months away as there was only one officer in Queensland available to complete the ballistics investigation and “he’s very busy”.

Magistrate Clare Kelly remanded Freund in custody and adjourned the case for mention back in the same court on March 10 when the court would be given an update on when the ballistics report was expected to be available.
