Bar Wunder: Mark Kenneth McElligott and Fiona Leigh Usher to appear in supreme court

The owners of the former Bar Wunder, who have been charged with alleged Covid-19 breaches dating back to 2021, have revealed they have a date set in the supreme court related to the charges.

The former owners of a Toowoomba bar charged with alleged Covid-19 compliance breaches have had their respective cases adjourned again in the city’s magistrates court.

Fiona Leigh Usher, 51, and Mark Kenneth McElligott, 57, were not required to be in court when their matters were mentioned on Friday.

The court heard the pair had an appearance scheduled for the supreme court on November 1 relating to the charges and that the matters should be adjourned to a date after that appearance.

Neither of the accused has yet been called upon to enter pleas to charges which include two counts each of failing to comply with Covid-19 direction – emergency officer, as the charges read on the court papers.

The former owners of Bar Wunder in Ruthven St were in 2021 fined more than $6000 for refusing to abide by Covid-19 restrictions including to enforce social distancing, mask mandates and excluding patrons who were not vaccinated.

At the time, the Queensland Police Service enforced temporary closures of the bar but the owners closed the bar in April 2022 claiming the mandates were ruining their business.

Noting the scheduled November 1 appearance, Magistrate Clare Kelly remanded Mr McElligott and Ms Usher on bail and adjourned their matters for mention back in the Magistrates Court on November 3.
