Hewett man Jack Biddle to be sentenced later this month for serious criminal trespass and theft

A young man fuelled by Xanax will learn his fate after he broke into a stranger’s home in a “spur-of-the-moment” decision.

Home invasion laws: Your rights in Australia when an intruder breaks in

A young man who was fuelled by Xanax said breaking into the home of a stranger was a “spur-of-the-moment” decision.

Jack Biddle, 21, will learn his fate later this month after his drug use escalated after the death of his best friend in a motorcycle crash.

During sentencing submissions, the District Court heard Biddle had been visiting a friend earlier in the evening on December 28.

Upon leaving the house he had been walking through the street in Blakeview where the victim lived.

“On the night of the offending he was heavily intoxicated by having consumed somewhere between five to 10 Xanax tablets over the course of the day,” Chris Pouras, for Biddle, said.

The court heard Biddle, who stole a phone charger during the home invasion, immediately decamped after seeing the lights come on and hearing noises.

“The offending in my submission was opportunistic, random and a spur-of-the moment decision to target the victim’s residence,” Mr Pouras said.

Biddle, of Hewett, pleaded guilty to serious criminal trespass and theft.

The court heard Biddle, who worked full time at a roof plumbing business, began taking drugs, including cocaine and cannabis, at 16.

“Mr Biddle’s consumption of illicit substances escalated around May 2020 after the death of his best friend in a motorcycle accident,” Mr Pouras said.

“It’s my submission that his poor mental health and substance abuse caused him to behave irrationally and in particular without giving any thoughts to the consequences of his actions.”

Biddle will be sentenced later this month.
