A Toowoomba woman landed herself in the watch house during a night out on the town, after she headbutted a man who she alleged was being inappropriate to her and her mates.
When the 28-year-old was sentenced before the Toowoomba Magistrates Court on Tuesday, April 22, the court heard Kristin-Jade Kathleen Dawes assaulted the man once at the Cube Hotel balcony on August 31, 2024.
The court heard before the incident occurred at 2.10am, the young woman reported the man’s alleged inappropriate behaviour and comments to a manager, who told Dawes to keep her distance.
Dawes then went to security, who asked her to point the man out.
She then went up to the man and placed an arm around his shoulder before a verbal argument ensued, leading to the headbutt.
During her imminent arrest, police found a taser that looked like a flashlight.
She told officers the man “was a piece of s-t,” and “had it coming”.
Solicitor Brad Skuse said Dawes thought more should have been done before the altercation, however conceded the offence was aggravated by her prior assault convictions, noting the woman was no longer drinking and attending counselling to address underlying factors and mental health conditions.
He said before Dawes entered a plea of guilty to assault occasioning bodily harm and weapon possession, he had made a submission to police prosecution about the charges, which failed.
Magistrate Kyna Morice told Dawes despite her earlier efforts to do the right thing, she went too far and committed a serious offence, which was further aggravated because she was on probation at the time.
She told the young mother she needed to address her anger issues and relationship with alcohol, however commended her for the work she had done to be a better role model for her child.
Dawes was sentenced to a three-month jail term, suspended for nine months, and fined $500.
