Toowoomba mates who bashed and rolled man to face justice together

Toowoomba acquaintances who beat a man before stealing his phone and beanie will be sentenced together for the crime before the higher courts.

The sentence of a young Toowoomba man who assaulted a man has been pushed to the end of 2024 so he can be sentenced alongside his co-offender.

On Monday, October 14, the Toowoomba District Court heard Joe Connor Heuer and Benjamin James Irwin assaulted a man, Rowan Ian Smith, on September 8 2023.

After being assaulted and injured, the court heard the pair stole Mr Smith’s phone and beanie.

Police charged Heuer with assault occasioning bodily harm, stealing, and drug charges relating to his possession of meth and oxycodone.

Heuer pleaded guilty to the above charges on Monday, however the sentence was adjourned to the next District Court sitting in December to line up with his co-accused’s sentence.

The court heard Irwin will be entering pleas of guilty to assault OBH and stealing, however his case was taking longer to progress through the courts because his lawyers were waiting on a psychologist’s report.

Heuer and Irwin will be sentenced together at a later date.
