A FRENCH national accused of stabbing an Airlie Beach security guard in the early hours of Monday morning, is still in custody, following court appearances in Proserpine and Mackay this week.
Bruno Robert Marcel Bastard, 30, initially appeared in the Proserpine Magistrate's Court on Monday charged with unlawful wounding at Magnums Hotel on July 14.
The matter was adjourned to Mackay for a possible bail application, but duty solicitor Antoinette Morton, of Morton Lawyers, told the court yesterday that would no longer be the case.
Police were called to Magnums Hotel at 2am on Monday where Bastard had been asked to leave by security guards. He allegedly became very aggressive and violent and started to throw punches at a security officer.
Police will allege he had a pair of scissors in his hands, used to inflict puncture wounds while punching.
Bastard's girlfriend, Soizic Marine Gaellic Deneboude, also a French national, was arrested with him on separate charges of common assault and being drunk and disorderly in a licensed premises.
The 26-year-old pleaded guilty to those charges in the Mackay Magistrate's Court yesterday and was in tears as she sat in the dock before Magistrate Ross Risson.
The court heard that at about 1.50am, Deneboude, who was playing pool with Bastard and another man and woman at Magnums, was asked by a security guard if they could finish their game as the area was about to be closed.
Ten minutes later Deneboude and the woman were dancing on the pool tables and were told to leave immediately. Police prosecutor Elizabeth Smith said it was this that caused Bastard and the other man to become aggressive with the security guard.
Ms Smith said as they were escorted out of the licensed venue, Deneboude charged at the security guard pushing him. She then walked up to a table and began throwing empty bottles before she was arrested.
Ms Morton said Deneboude, who is a sociology student, had been living in Airlie Beach with Bastard, where the two worked as artists making bracelets to sell. She had hoped to obtain a permanent visa to live in Australia, but would now be returning to France on August 20.
Ms Morton said Deneboude was "extremely remorseful" for her actions and "extremely distressed" about the serious charge against her partner.
Mr Risson accepted the assault was "simply a push" and fined her $500.
He did not record a conviction because of her lack of history.
Ms Smith asked for Bastard's matter to be adjourned back to Proserpine for mention on August 11. He was given leave to appear by telephone.
The security guard he wounded was taken to Proserpine Hospital and treated at the emergency department but left that same day.
