Out-of-town worker accused of Airlie Beach nightclub assaults seeks bail variation

A man has pushed to have his bail altered arguing the conditions stopped him dining out after work.

A Whitsunday man facing multiple charges including serious assault police has appealed to vary his bail because he cannot go out for dinner under the strict conditions.

The Cannon Valley man is charged with assault, serious assault, obstructing police and public nuisance following an alleged incident at Boom Nightclub on May 2.

He appeared in Proserpine Magistrates Court this week to ask that a bail condition preventing him from attending licenced premises anywhere within the state of Queensland be reviewed.

His solicitor Danny Yarrow, via telephone, requested the ban be reduced only to cover the Airlie Beach Safe Night Precinct, as the blanket ban was disrupting his client’s social life.

“He works out of town and he tries to go out for dinner, and most of the places he goes to do hold licences and he’s unable to attend those places at all,” Mr Yarrow said.

Magistrate Ron Muirhead agreed to reduce the ban to licensed premises “in the Airlie Beach, Proserpine area”.

The charges were adjourned to May 31.
