Oisin Thomas Treacy-Santo sentenced for wilful damage

A ‘fairly intoxicated’ miner who urinated on a Whitsunday police officer’s car was caught on CCTV on the same night he gave police the fingers. The local magistrate was less than impressed.

A drunken miner was caught on wild night out that involved urinating on a police officer’s car.

Oisin Thomas Treacy-Santo, 25, broke into the Whitsunday police station car park on the night of November 14 and was caught on CCTV peeing on one of the cars which belonged to a police officer.

The Nauru man was then observed on that same night walking along Shute Harbour Rd towards Airlie Beach and giving police officers fingers when they drove past at around 2:50am.

Police prosecutor Sergeant Emma Myors said Treacy-Santo had breached a ban from the Airlie Beach safe night precinct as he was only allowed to go “straight to his accommodation”, but had walked towards police officers around McDonalds and gave them his fingers once again past 3am.

At the time police were attending to an incident and providing support to the ambulance service, and Treacy-Santo had started arguing with members of the public near the scene.

The police officers had told him he had to go straight to his accommodation or he would be arrested, but he remained and was arrested.

When at the police station, he had told the officers that he had urinated on the car because: ‘You can’t smoke or pee on the way back to town”.

Ms Myors told the court the car had needed a comprehensive cleaning afterwards.

PD Law solicitor Peta Vernon told the court Mr Treacy-Santo had been “fairly intoxicated” which would have been the reason for his behaviour as he had no previous relevant history.

Ms Vernon told the court the officer’s car had not been damaged extensively and asked for the conviction not to be recorded as he had no prior history and that it could be an issue for him to visit back home on the island.

Magistrate Michelle Howard told Mr Treacy-Santo this was “disgusting behaviour” and that “police are just doing their job”.

Mr Treacy Santo pleaded guilty to wilful damage, contravening a police banning notice and to be found or have left a police establishment without a lawful excuse.

He was fined $1000. No conviction was recorded.
