Nicole Joanne Burgess faces court after lashing out at police at Airlie Beach bar

An Airlie Beach babysitter ended a night out in the back of a paddy wagon after lashing out at police as they heard details of an unwelcome advance she received from some men at a bar.

Proserpine Magistrates Court heard Nicole Joanne Burgess advanced towards police with her hands raised in a fighting stance, calling the officers “dogs” and “c*nts” as her husband spoke to them about the alleged assault outside KC’s Bar and Grill about 10.40pm on May 5.

She was arrested after her husband’s attempts to restrain the 38 year old failed, but continued resisting and “trying to break away”.

The court heard she grabbed one of the officers’ radios and “refused to let go”, Prosecutor Robert Beamish told the court.

Solicitor Elizabeth Smith said her client – who pleaded guilty to commit public nuisance and obstruct police – had been drinking margaritas with her FIFO-worker husband at KC’s and “having a perfectly fine time” until “some fellows decided to smack her on the backside” as the couple left the Shute Harbour Rd venue.

“That caused her to become quite agitated,” Ms Smith said.

“Her husband also got quite upset about the situation and they were out on the street and police have then attended and things have escalated primarily due to the level of alcohol that they had on board.”

Magistrate James Morton said there was “nothing worse than seeing a drunken woman carrying on” and fined the mother of four $300.

“Calling police ‘dogs’ and ‘c*nts’ – that may be so but you don’t do that,” Mr Morton said.

No convictions were recorded.
