Jessica Elizabeth Leech, charged with 16 offences including trafficking, supplying and producing drugs, was released on bail after 11 months on remand

A magistrate has given an alleged Airlie Beach drug trafficker “one final chance” on bail, despite strong police objections to her release.

Jessica Elizabeth Leech is accused of producing and trafficking dangerous drugs.

Police prosecutor Sergeant Jay Merchant opposed bail for Jessica Elizabeth Leech at Proserpine Magistrates Court this week arguing she had not complied with past conditions and was an unacceptable risk of committing further offences.

Ms Leech is facing 16 charges including possessing, supplying, producing and trafficking dangerous drugs, dangerous driving, drug driving while on a learner or provisional licence and evading police.

She has been on remand since her arrest in July last year, and her solicitor Elizabeth Smith argued it would be unfair for her to spend any more time in custody while waiting for the matters to be finalised.

Police allege Ms Leech was found in a hotel room with 73 grams of methylamphetamine, however Ms Smith said her client did not accept she had knowledge or control of the drugs at the time of her arrest and would be contesting that aspect of the charges.

The court heard police originally alleged Ms Leech possessed 1.1kg of MDMA, but Ms Smith said subsequent analysis had changed the allegation to 73 grams of methylamphetamine.

Ms Smith said her client had “benefited” from her time in pre-sentence custody in that she had “not consumed any drugs” and had “basically been able to rehabilitate herself”.

“There can be some comfort that she can continue on that course if she’s given bail,” Ms Smith said.

Sergeant Merchant however, told the court Ms Leech “keeps committing further offences while on bail”, including failing to appear and the alleged drug related offences in question.

He said he was not convinced the suggested bail conditions, including an ankle monitor, would prevent this happening again.

Magistrate Ron Muirhead decided Ms Leech “should get one final chance at bail” given it would be “some time” before her more serious charges were finalised in a higher court.

Mr Muirhead granted bail with conditions including reporting to Mackay Police Station three times a week and a night curfew, but said GPS tracking was not necessary.

Some matters were adjourned to August, while the more serious charges will go to the supreme court later in the year.

Ms Leech is banned from going to the Whitsunday region except to attend court.
