Chelsie Brooke Jury faces court for drug driving, driving unlicensed

A young woman insisted she tested positive to cannabis because she shared a room with a smoker — she only consumed cocaine herself.

A young woman has faced court after she drove unlicensed with drugs in her system because she needed a new outfit.

Chelsie Brooke Jury appeared in Proserpine Magistrates Court on March 11 charged with driving without a licence while disqualified by a court order and driving with a relevant drug in her saliva.

At around 4pm on 28 December she was pulled over on Wills Court, Cannonvale where the court heard a check on her drivers licence showed five current disqualifications including a 48 month disqualification, 36 month disqualification, 12 month disqualification, and 24 month disqualification from June 2024, as well as a 24 month disqualification from September 2024.

Lucy Hughes for prosecution said Ms Jury had an “extremely concerning traffic history” with multiple similar charges.

She was also on probation at the time of the offence.

When questioned by police as to why she was behind the wheel, Ms Jury told police she had a party to go to that evening and drove into town to get a new outfit.

A drug test returned a positive reading for cannabis with Ms Jury telling police she took cocaine a week prior and was simply in the same room as her boyfriend who smokes cannabis.

Giulian Grasso solicitor at Whitsunday Law appeared on behalf of Ms Jury telling the court the 24-year-old’s employer had provided a reference and spoke extremely highly of her.

“I’m not sure how accurate it is, she said that she’s dedicated to health and fitness, I mean she’s got an awful history with respect to drug driving and drink driving,” said Magistrate Anna Smith.

“I’m not sure the employer knows her that well.”

Magistrate Smith said she did not accept that the drugs in her saliva were from passive inhalation while her boyfriend was smoking.

“She’s basically just thumbing her nose at what the court tells he to do, she says no I don’t care, I’ve got a party to go to I need to buy a new dress,” said Magistrate Smith.

“It’s not even I have to go to work, or a tradesperson, I’ve got four children and I realise I’m doing the wrong thing but I can’t work, it’s I need a new dress for a party.”

Ms Jury was sentenced to 12 months imprisonment wholly suspended with an operational period of 18 months and a 3 year licence disqualification for driving while disqualified and an $800 fine and 4 month disqualification for drug driving.

“If you were any older you would go into custody today,” said Magistrate Smith.

“You keep doing it, you can’t do it or you’re going to jail.

“You will serve time if you do it again, by the skin of your teeth you are not going into custody today.”

Convictions were recorded.
