Jason Allen Martin jailed for bestiality after instructing sickening attack from hospital bed

A Warwick man who orchestrated an ‘atrocious’ attack on an innocent young woman and gave instructions over the phone to his co-offenders to commit acts of torture, rape and bestiality against her, has faced court.

A Warwick man who orchestrated an “atrocious” attack on an innocent young woman and gave instructions over the phone to his co-offenders to commit acts of torture, rape and bestiality against her has faced court.

Jason Allen Martin stood mostly silent in a brown prison tracksuit as he appeared in Warwick District Court on February 1 for his role in a shocking and sickening attack on a young woman in 2022.

Almost two years ago on February 25, 2022 Martin was laying in a Princess Alexandra Hospital bed after being shot in the abdomen 10 days earlier in a brazen broad daylight shooting.

The court was told that Martin, from the hospital, delivered sickening instructions over the phone to co-offenders Duane Edward Nixon and Melinda Maree Orchard after they had abducted the young woman and taken her to his home.

It was revealed in court the abduction was planned by the trio in order to have the victim contact police and implicate another party in the shooting of Martin.

However it was later revealed the woman who Martin, Nixon and Orchard subjected to “unimaginable trauma” had no involvement in the shooting and her abduction and prolonged assault was a case of mistaken identity.

Crown prosecutor Sam Rigby detailed how Martin instructed Nixon and Orchard to “torture that dog,” to which Orchard laughed, and discussed tasering the woman.

Martin encouraged his female co-offender by saying “good, zap her so I can hear it” over the phone.

Martin then instructed Nixon that “the (victim) was to be raped” before instructing Orchard to record the crime.

“He was the mastermind, the ringleader and gave those instructions … the fact that he ordered the co-accused to record the act goes to the depravity of this offending,” Mr Rigby said during his summing up of the matter.

The court was told how the woman was subjected to horrific physical and sexual violence, including striking her legs in order to prevent escape, which left substantial trauma.

Sickeningly, the court was told Nixon raped the woman before forcing the woman to endure a sex act with a dog, while it was being recorded and later found by police on Martin’s phone.

Mr Rigby detailed how Martin had ordered Orchard by telling her on the phone “you need to record the rape, ha ha, let the dogs do it, get her on all fours... record it and send it to me”.

Police had seized Martin’s phone while he was in hospital and found an image of the victim alongside history of phone calls and messages between him and Nixon during the offending period.

The crown prosecutor dubbed the offending as “humiliating, inhumane and in complete disregard of the wellbeing and safety of another human being”.

The court was told Martin had a lengthy criminal history stretching back over a decade, across three different states.

He was jailed in 2020 for a violent home invasion at Toowoomba which occurred in 2019, which saw a man tasered, beaten and robbed.

At the time of this offending, he was released on parole.

The man pleaded guilty to the charges of bestiality, threatening violence at night and recording in breach of privacy, in Warwick District Court on February 1.

Judge Nathan Jarro said the crimes Martin contributed to were categorised as “some of the most sickening, vile and degrading offences” which could be inflicted onto a person.

The justice labelled Martin as “atrocious” and said the community would not tolerate his “low life and hideous offending” and that he deserved contempt from the community.

Martin was imprisoned for a total period of three and a half years, with his parole eligibility dated at February 1.

His 229 days in custody were considered time served and convictions were recorded.

Melinda Maree Orchard was sentenced to six years in jail, with eligibility of parole after two, with Judge Terry Gardiner sentencing her in August 2023.

Duane Edward Nixon was sentenced to 10 years in June 2023 by Judge Dennis Lynch KC.

Orchard will be eligible for parole on February 25, 2024.
