Naomi Elliot pleads guilty in Warwick Magistrates Court to weapon possession, drug supply, harassment

A Warwick woman was labelled as ‘extremely concerning’ by a magistrate as a court was told she published the confidential contents of a domestic violence order online.

A Warwick woman quickly racked up a string of drug and weapon charges following a period of offending which was labelled by the magistrate as “extremely concerning”.

Naomi Elliott pleaded guilty to a string of 13 charges in Warwick Magistrates Court on Wednesday, relating to drug offences and weapon possession.

The charges related to two periods of offending, the first, from November 30, included two charges of possessing dangerous drugs, one charge of each possessing used utensils, possession of items used in commission of crime, possession of property suspected to be proceeds of a drug offence and three charges of supplying dangerous drugs.

Furthermore, in the second period of offending, dating from February 21, 2023, Elliott was charged with two offences of possessing dangerous drugs, and once charge each of possessing a category R weapon and possessing used a drug utensil.

Elliott also faced a separate Commonwealth charge of using a carrier service to menace or harass from November 30 to December 5, 2022.

Elliott pleaded guilty to all charges.

The court was told the 45-year-old, who had “similar offending” dating back a decade, supplied cannabis and possessed both methamphetamine and cannabis on several occasions.

On November 30, 2022, after search of a residence Elliott was revealed by officers to be in possession of dangerous drugs, being cannabis and amphetamine, alongside a used pipe, cash and grinder and clip seal bag. The court was told a phone that was believed to be used to supply drugs was also found.

Months later, on February 21, 2023 the court was told that following a search warrant by police, it was revealed Elliott was possessing both cannabis and meth, as well as a used grinder, pipe and taser.

The court was told that from November 30 to December 5, 2022, Elliott also used a carrier service to menace and harass a person.

Records show messages sent included “you are a f--king c--t, everyone can see,” and “watch over your shoulder” sent by Elliott.
The court was told the woman that Elliott had published details over Facebook regarding a person making “false statements” in order to get a DVO, writing “how putrid can you get” before posting a copy of the application.

The application had the full details of the victim involved, including the name and the particulars of the application, which was labelled as “extremely concerning” by the magistrate.

Defence lawyer Sarah Campbell said the woman had a “history with drugs and had been forthright with addiction” and “significant stress” had caused her to say and do things which are “out of character”.

“The supply charges are in the context of supporting her own habit rather than an extensive commercial purpose, she admits to drug problem and in that context the drug offending has occurred,” Ms Campbell said.

Magistrate Andrew Cridland was quick to label the offending as “extremely concerning” and “serious” and noted that Elliott had a history which showed she had a “problem with drug usage”.

“It’s concerning in this circumstance, the offence of using a carrier service and publishing a DV application is a serious way to menace or harass a person to stir sentiment or feelings towards them,” he said.

For the Commonwealth charge of menace and harassment via a carriage service, Elliott was sentenced to three months’ imprisonment, released immediately on a good behaviour bond for one year. No conviction was recorded.

For all other offences relating to drugs and weapons, Mr Cridland sentenced her to 18 months’ jail with immediate parole, with all property forfeited. No conviction was recorded.
