Union claims Queensland teachers threatened with school lockout unless wage deal struck

THOUSANDS of Queensland’s Catholic school teachers could be “locked out” of their classrooms if a new wage deal is not struck between the sector’s employers and staff by midweek, the union has claimed.

The independent Education Union of Australia says more than 7000 teachers and staff at almost 200 schools across the state participating in partial work bans could be forced off-site altogether if the current wage offer on the table was not accepted by 5pm Wednesday.

In a letter to all staff Friday, Queensland’s Catholic school employers confirmed a notice in accordance with section 471 (4) of the Fair Work Act would be issued on Thursday and take effect on Friday if a deal was not done.

Under the legislation, employees who continue to participate in the partial work bans – which include not performing playground supervision, attending staff meetings and conducting data collection – would not be entitled to any wages and could be refused any work for the entire day unless they perform all duties.

Along with the work bans, some staff took part in a 30-minute stop work action earlier this month.

The letter outlined that an offer of guaranteed backpay was also in jeopardy unless an agreement was reached this week.

IEUA Queensland and Northern Territory branch secretary Terry Burke today accused Queensland’s Catholic school employers of becoming “the first Catholic school employer in Australia to threaten to lockout their teachers and support staff”.

“Queensland Catholic school employers have now resorted to threats and bullying tactics in an effort to force an outcome regarding current collective bargaining negotiations,” Mr Burke said.

“That threat is to lockout staff – meaning they would be denied entry to school sites and prohibited from doing any work on school grounds,” he said.

But the Queensland Catholic Education Commission said a lockout was “the exact opposite of what they were seeking” and that “employers would like all staff to come to work and perform their normal duties.”

“Employers are not preventing staff from coming to work,” QCEC executive director Lee-Anne Perry said.

“Employers respect the right of staff to take protected industrial action.

“The union is misrepresenting the facts, at a time of year when we should be celebrating the work of our students.

“What employers have said is that if negotiations are not finalised or the union does not lift current work bans then employers intend to exercise their right under the Fair Work Act to withhold payment for days when employees don’t carry out their full duties.”

Dr Perry said employers were committed to giving employees a chance to vote on a proposed agreement as soon as possible.

“Employers also want to support those staff who have had to take on extra duties to cover some union members engaged in work bans as part of protected industrial action,” she said.

Negotiations have dragged on for months, with the union pushing for all staff to receive a $1250 one-off payment which they claim will keep Catholic teachers on par with the state sector.

But employers have argued the public school payment is akin to a stimulus package and instead have offered a 2.5 per cent wage increase, backpay to July 1 and a $500 one-off payment in return for a four-year wage agreement.

Mr Burke said union members were meeting urgently today and tomorrow to discuss their next course of action.

“As teachers and school professionals, they know bullying behaviour and threats of harm cannot be ignored – and just like in our schools, in the face of bullying a measured and considered response is appropriate,” he said.

“That Queensland Catholic school employers would resort to such threats and intimidation clearly shows they have run out of ideas and that they are inept and incapable of identifying real responses to employee concerns over workload and wage parity.”
