‘Too old to be out’: Man jailed over cowardly attack on two ‘older blokes’ outside Brisbane’s Victory Hotel

TWO men in Brisbane for cancer treatment were savagely bashed by a drunk and drug-addled patron who accused them of being “too old” to be dining at a CBD pub.

Dylan Bradley Castle, 25, yesterday in the Brisbane District Court was jailed for 4½ years for a vicious and unprovoked attack that left Graham Law, 64, and brother-in-law Terrence White, 73, with broken bones.

Castle pleaded guilty to grievous bodily harm and the serious assault of a person over 60.

Judge Terry Martin released security-camera footage of the violent assault outside The Victory Hotel on July 1 last year, adding it was in the public interest to have it broadcast as it clearly showed the “forceful and ugly nature of the attack”.

“You cannot escape responsibility for your actions when voluntarily intoxicated by mind-addling illicit drugs, you must have had insight into your capacity to be violent,” he said.

Judge Martin said he accepted Castle was remorseful for his actions but the case against him was strong.

Mr Law said he had been back to the hotel on Edward St since but still couldn’t make sense of the attack.

“I’ve never seen anything so cowardly in all my life, a young bloke like that coming from behind on two older blokes. He did a bit of damage,” he said.

Mr Law said he was pleased Castle would serve at least 18 months in jail before being considered for parole.

“I still got a few sore spots over it that I am going to have for a long time, but you know I’ve tried to forget it, but my brother-in-law he has nightmares still,” he said.

Mr Law and Mr White were attacked the day before they were due at the Royal Brisbane and Women’s Hospital for Mr Law’s scheduled treatment for bone cancer.

They were eating dinner and watching footy at the hotel when Castle commented that he thought the men were “too old to be here” after 9pm.

Judge Martin sentenced Castle to three years’ jail for assault and 4½ years for grievous bodily harm.

He set parole eligibility for January 2, 2015, after 305 days in pre-sentence custody.
