A Brisbane teacher and mother-of-two has been fined after drink driving and failing to provide a breath sample while holidaying in Noosa.
Jasmin Stephenson, 42, was charged with driving under the influence of alcohol or a drug on January 29, 2021, during the school holidays.
Calls were made to police regarding a disturbance at the Noosa Spit involving a woman and they found Stephenson driving her car a short time later.
Police pulled the Alexandra Hills resident over and noticed she was slurring her words.
Police detained Stephenson and she started crying before refusing to be breathalysed.
Solicitor Luke Bull said Stephenson had been staying at an Airbnb in Noosa and became “so depressed” that she started drinking in her car.
“The combination of alcohol and the medication in her system has led to her being intoxicated and picked up by police,” Mr Bull said.
Mr Bull told the court Stephenson did not have any criminal history and had lost seven people in her family.
“Her depression and anxiety got so bad that she was committed to a mental health facility … she has been trying to address those issues,” he said.
Magistrate Matthew McLaughlin said while police weren’t able to provide a reading of how much alcohol was in Stephenson’s system, it needed to be regarded as a serious offence.
“The law in Queensland says that if you refuse to provide a specimen, you are automatically guilty of the high level offence,” Mr McLaughlin said.
He fined Stephenson $1000 and disqualified her from driving for 10 months for the drink driving offence which she pleaded guilty to in Noosa Magistrates Court on Tuesday.
A conviction was recorded.
