A Buderim registered nurse and mum-of-three has come back before court after she was busted with a collection of marijuana plants on her balcony.
Rebecca Anne Moussalli’s house was searched on October 6 at 4.45pm where police discovered four individually potted plants ranging in height from 1.05m to 1.2m.
Officers also found a ceramic bowl in the kitchen with 7g of dried marijuana inside.
The 40-year-old had come before the court in June for growing three plants and possessing 89g of dried cannabis.
Moussalli didn’t have convictions recorded for four counts of possessing dangerous drugs, one count of producing a dangerous drug, one count of possessing property used in connection with a drug offence and one count of possessing utensils.
The court heard Moussalli was a registered nurse at Sunshine Coast University Hospital.
Defence solicitor Belinda Robinson said her client was required to disclose her criminal convictions and recording a conviction would be prejudicial to her renewal of her nurse registration and her current position.
Magistrate Haydn Stjernqvist questioned why Moussalli’s history of drug offending hadn’t already caused issues with her employment.
“If she was going to have a problem it would have already surfaced,” Magistrate Stjernqvist said.
Ms Robinson said while Moussalli had disclosed her previous history to the regulation agency and her employers, it hadn’t affected her position yet.
“A criminal conviction could be viewed in a more serious light,” she said.
Magistrate Stjernqvist said Moussalli must not be worried about her offending as she was back in court just four months later.
Ms Moussalli told the court she had prescription marijuana and was only producing the plants for her own use.
“You’re minimising this offending to be making a statement like that,” Magistrate Stjernqvist replied.
Moussalli then said “I am a nurse, I have done training in this area, the prescription is also expensive”.
Moussalli pleaded guilty to possessing dangerous drugs and producing dangerous drugs in Maroochydore Magistrates Court on November 24.
Magistrate Stjernqvist decided not to record a conviction against Moussalli and fined her $1000.
