The owners of a large Noosa hinterland property have filed a court application against the council regarding their plans to transform the existing macadamia farm into a wedding venue.
The company and landowner, Louis Bazzo Pty Ltd, filed an application with the Planning and Environment Court last month, to appeal against the Noosa Council’s development approval conditions.
The 99ha block on Louis Bazzo Rd in Ringtail Creek, between Pomona and Noosa, currently operates as a macadamia farm, with a large dam in the centre of the property and established machinery sheds.
According to property data the macadamia farm was last sold in December, 2023 for $3.15m to Louis Bazzo Pty Ltd.
The development application submitted by the landowners to the Noosa Council in June last year showed plans to build a wedding marquee as well as a cocktail and canape terrace with a jetty and deck over the property’s dam.
The council approved the development application with a number of conditions, including a rule ensuring all guests leave the property before 10.30pm.
The conditions also prohibit events being held at the property on public holidays and Sundays, unless followed by a public holiday.
The planning court documents stated there was no reason the venue could not operate until the later time of 11pm, with guests leaving the property before midnight.
“Conditions 8 and 9 limit the hours of operation of the approved use to 10pm, with guests having to vacate the premises by 10.30pm,” the planning court application stated.
“The evidence demonstrates that the approved use could operate to at least 11pm without any unreasonable adverse impacts on sensitive receptors caused by the approved development including with guests departing by 12pm midnight.”
The documents also argued against the council’s condition an onsite manager be present at all times during an event.
Among the four directors of the company, Louis Bazzo Pty Ltd, is Simon Skerrett who established the popular wedding venue, Rosewood Estate, in Beechmont in 2019.
