A Sunshine Coast civil construction worker has admitted to going commando when he accidentally exposed his penis to a 15-year-old girl who served him in a cafe drive through.
Maroochydore Magistrates Court heard last week how Zane Glenn Petersen, who said he sometimes chose not to wear undies on the weekends, accidentally revealed his penis to an underage girl at a coffee business’ drive-through line on October 20.
Police prosecutor Mel Pyke said the 15-year-old staff member was taking orders from patrons in the drive-through line about 8.30am when she approached the 41-year-old man’s vehicle.
Sergeant Pyke said when the young girl approached the driver side window, she could see Petersen’s exposed genitalia.
The court heard the teenager alleged she saw the church volunteer masturbating while she took his order.
She believed it was an accident but was “stunned” as she repeated his order to him, the court was told.
The police prosecutor said the girl told her supervisor. It was later reported to police.
Sergeant Pyke said the civil construction worker and father was interviewed by officers, when he said he was wearing “short shorts” and his “old fella was hanging out” of the side of his pants.
He told police he tried to put his hand over his penis to cover it and “put it away”.
Petersen denied masturbating and said if he was out on the weekends he might not wear underwear.
The 41-year-old was charged with wilful exposure and pleaded guilty to the charge in court last week.
Defence solicitor Jacob Pruden said Petersen was embarrassed and remorseful at how he put himself and his family through the ordeal.
Mr Pruden was instructed the civil construction worker was not expecting to be served at his car and wore no underwear, which was a “custom” for him sometimes on the weekends.
The lawyer said it was only later he became aware his penis was exposed.
Acting magistrate Raelene Ellis accepted there was “no deliberateness” and was a “misjudgment” from Petersen. She decided not to record a conviction against the 41-year-old.
He was instead fined $322.60.
