Tyson Shaw-Holland pleads guilty to assaulting former partner at Marcoola

A concrete pumper has admitted to assaulting his former partner after he pinned her to the ground and refused to let her go before she fled in fear.

A concrete pumper who was once jailed for savagely attacking man with a pole and kicking his dog has walked from court after assaulting his former partner.

Tyson James Shaw-Holland was told in Maroochydore Magistrates Court on Thursday to think of how his victims feel after he wrote a letter to the court saying incarceration would set his life and rehabilitation back.

“Why don’t you think about the victims before you say things like that,” magistrate Rod Madsen told the 24-year-old, after he pleaded guilty to assault occasioning bodily harm and contravening a domestic violence order.

Mr Madsen said Shaw-Holland’s assault on June 14 involved the concrete pumper forcefully pinning the woman to the ground by her shoulders, with her asking him to let her go. He refused.

“You’re not f---ing going anywhere,” the magistrate quoted the Marcoola man saying.

“She’s scared because of what you did.”

The Marcoola man continued to pin his former partner down by placing pressure on her arms and shoulders which caused pain and discomfort, before she fled from the house to find help.

Mr Madsen said the woman only returned to the home the next day because she knew Shaw-Holland was at work.

Police prosecutor Tara Miles said this was not Shaw-Holland’s first brush with the criminal justice system, after he pleaded guilty to grievous bodily harm and animal cruelty in 2021.

He received three years and nine months’ jail, to be suspended after serving 12 months of actual time for attacking a man with a metal implement and kicking his dog.

Defence lawyer Belinda Robinson said the Marcoola man came from a prejudicial upbringing which was marred by domestic violence.

Ms Robinson said this involved a problematic relationship between Shaw-Holland and his father who normalised drinking and taking drugs at home and at work.

His lawyer said the 24-year-old was involved in an “unhealthy relationship” with the victim for about six months which was characterised by drug use, with Shaw-Holland conceding he could only partly recall the assault.

She was instructed by the Marcoola man he understood his offending was unacceptable and he was very remorseful.

Ms Robinson said he has taken part in counselling and moved to Gympie for a “fresh start”.

Mr Madsen said some people also experience the “most unfortunate of circumstances” and seek to have their conduct minimised because of this at sentence.

“There are just as many people who have the same tragic circumstances and they manage to live life fully, not being violent towards people, not coercive or controlling people,” Mr Madsen said.

He however acknowledged the 24-year-old’s remorse, his youth and his rehabilitation plan to change his ways.

Shaw-Holland was sentenced to 12 months’ jail with immediate parole.
