Man refused bail after alleged Mooloolaba stabbing with teenager

Explosive allegations have been heard in court following an alleged stabbing where it’s claimed two men donned balaclavas before they were grievously injured.

Bombshell claims have been made in the case of a man and a teenager accused of being involved in a frenzied stabbing outside a Sunshine Coast home that they were targeted by the alleged victims.

The allegations were made in Maroochydore Magistrates Court on Wednesday by defence solicitor Matthew Cooper after police alleged the Mooloolaba man and the teenager grievously injured two men, aged 36 and 30, following a fight on the street on Sunday night.

The court was told how the assaults included a man being allegedly stabbed by the 54-year-old while another was struck with a plank of wood.

A day after the frenzied alleged affray, the 54-year-old was arrested and charged with two counts of acts intended to cause grievous bodily harm and one of serious assault and spent three days in the Maroochydore watch-house up until his court appearance this week, where he appeared by video.

The teenager was also arrested but bailed on two counts of acts intended to cause grievous bodily harm, with his matters still before the courts.

“How this incident started is not normal, it is abnormal,” Mr Cooper told the court.

In a surprise allegation, Mr Cooper claimed his client did not seek out the victims but was rather set upon.

Mr Cooper said it was alleged the victims donned balaclavas or masks to disguise their appearance and covered their registration plates on their vehicle with tape before they parked it.

It’s here Mr Cooper claimed the men set upon the man.

“They quite clearly were not (there) to just have a chat … they were there to inflict violence and they did inflict violence,” Mr Cooper said.

Mr Cooper said what was clear in bail objection documents before the court was the absence of the man’s injuries which required staples to his head after being allegedly hit with an implement by the two men.

The 54-year-old also suffered defensive wounds on his forearms along with cuts to his knees and required a stay in hospital, the court was told.

Mr Cooper said his client had no idea who the alleged victims were.

The defence solicitor, in his push for the man’s release, said there were legitimate issues of self defence which would need to play out before a jury.

Magistrate Raelene Ellis however interjected and spoke of other allegations in the lead up to the alleged stabbing, where the 54-year-old was accused of pushing a 79-year-old man over on June 27.

In another alleged incident that same day, Ms Ellis said the 54-year-old was involved in an argument with a road worker, however Mr Cooper alleged the worker punched the man first. He was not charged over this incident.

Mr Cooper said the 54-year-old also disputed the serious assault claim.

He told the court the Mooloolaba man also had an address he could live at to reduce risk.

The solicitor said the man was the main breadwinner for the family and claimed his incarceration would severely impact them financially.

Police prosecutor Mark Burrell objected to the man’s bail and claimed the 54-year-old’s actions went “well beyond” self defence in what he alleged was an “extremely violent incident”.

Acting Senior Sergeant Burrell however accepted there were “question marks” over the intent of the alleged victims. The court was told these two men have not been charged.

Ms Ellis said it was a “highly unusual” case but cited incidents of violence on the man’s history and refused his bail application.

His matters will return to court in August.
