Levi Robert May sentenced in Maroochydore court for outburst at Sunshine Plaza

A 21-year-old bit a police officer who tried to stop him from eating a bag of crystal meth from his pants, before two syringes fell from his bottom during a violent outburst.

Levi Robert May was sentenced to a one-year suspended sentence in Maroochydore Magistrates Court on Tuesday after he pleaded guilty to a string of 14 charges including two counts of serious assault of a police officer while adversely affected in a public place and serious assault of a public officer by biting.

May had been arrested and was struggling with police in the Maroochydore watch-house when he reached into his pants and grabbed out a bag of meth that he tried to eat on January 14.

Police prosecutor Stuart Lydford said a female police officer tried to stop May from swallowing the drugs when he bit her forearm.

The officer’s skin was not broken.

It was then police were trying to search the 21-year-old for more drugs when two hypodermic needles fell from his bottom.

“An item fell from his anus … a shortened hypodermic syringe wrapped in gladwrap covered in faeces,” Sergeant Lydford said.

He said May was arrested by a team of police officers after he was spotted by concerned members of the public acting strangely with handfuls of cash at a Sunshine Plaza jewellery store.

The court heard he was struggling and trying to wriggle away from police in an effort to keep the drugs hidden when he assaulted several police officers.

May forcibly punched a female officer to her abdomen, injured one officer’s thumb and cut his hand, before straining and cutting another's knee during his violent outburst.

May also assaulted two security guards who tried to assist officers.

After several minutes a team of police restrained May and took him back to the Maroochydore watch-house where his outburst continued.

Magistrate Matthew McLaughlin, who said May was clearly “off his head”, was on two years’ parole for previous drug charges when he committed the offences.

Mr McLaughlin said if given a prison sentence for the offending May was unlikely to get parole and would serve the entire sentence.

He said serving the entire sentence would be too harsh for the offending.

Sergeant Lydford said May, who had spent 281 days in prison since the offence had done his time.

May’s lawyer said the 21-year-old had already done a significant amount of time in custody and suggested a suspended sentence as an appropriate punishment that would provide a solution to the doubts surrounding parole.

He said May had no violent offences on his history and would live with his mum in Gympie upon his release.

The court heard May was also accused of bringing drugs into a correctional facility and would be remanded until he was given bail or the matters were dealt with.

May was also found in possession of cocaine, meth and Xanax on November 10.

May’s prison sentence was suspended for two years.

He was also ordered to complete 40 hours of community service within six months of his release.
