A disability pensioner struggles to put false teeth into his mouth due to the lingering injuries he suffered in an assault by a Nambour man at a church’s burger night.

Dylan James Brown Winning, 26, told police he confronted the 60-year-old man at the Anglican Parish of Nambour on May 12, 2023 claiming the victim brushed up against his partner.

Maroochydore Magistrates Court heard on Tuesday it was at the church’s burger night for the homeless where Brown Winning struck the man in the back of the head, which caused him multiple injuries.

Police prosecutor Jeanette Grigoris retold the serious attack on the disability support pensioner after the 26-year-old pleaded guilty to assault, trespass, wilful damage and obstructing police.

The court heard the Nambour man came to the church with his partner when Brown Winning took issue with the victim, where he claimed he brushed up against her.

Police say the victim tried to walk away from Brown Winning when he was punched from behind and suffered “extreme pain”. This included numbness to the side of his face, a swollen eye, cheek pain as well as psychological trauma.

In his victim impact statement to the court, the 60-year-old man said he feared walking outside at night unless armed with a walking stick and never returned to the church night where he was assaulted.

The court heard he even struggled to put his false teeth back in due to the “devastating” attack.

Defence lawyer Katie Paterson said the 26-year-old didn’t recall punching the victim and stated he was remorseful for the attack.

Ms Paterson told the court Brown Winning was also using meth at the time and was unemployed.

Magistrate Haydn Stjernqvist told Brown Winning the only remorse he showed was through his guilty plea for the “unprovoked” assault on a “senior member of society”.

Brown Winning was jailed for 18 months, but with 236 days as time served he was released on parole Tuesday.

Convictions were recorded.
