Cocaine found after drunk driver flees RBT

A 25-YEAR-old man has been convicted and fined a total of $1350 for drink-driving, attempting to evade police and possessing cocaine.

Carlos Rodolpho Nery, of Peregian Beach, was already on a restricted licence from a previous offence when he apprehended in Noosa while driving outside its allowable hours on August 11, Noosa Magistrates Court heard on Tuesday.

Police were conducting random breath tests on Noosa Parade when they saw Nery’s vehicle speed into a side-street in an apparent attempt to evade the testing.

Police stopped Nery’s car in Russell St and found a small amount of white powder in a search.

It was subsequently identified as cocaine.

Nery recorded a blood alcohol content of 0.169.

Duty Solicitor Rose Killip said Nery had been depressed and drinking more after a knee injury, which had apparently curtailed a potential soccer career.

“He does have good prospects,” Ms Killip said, and sought a maximum one-year licence suspension for Nery, who had pleaded guilty.

Magistrate Hayden Stjernqvist took into account Nery’s previous traffic offences.

He disqualified Nery’s licence for 12 months.

He also fined Nery $800 for the drink-driving offence and $550 for cocaine possession, with a conviction recorded.
