Charles George Crews pleads guilty to leaving offensive messages on a strangers voicemail

A Coast dad who drunkenly left lewd messages asking a stranger to tickle his balls thought he was calling a scammer, a court has heard.

Charles George Crews, 44, said he was the one who had called a random phone number multiple times on May 20.

Police prosecutor Stu Lydford said the Parrearra man had started calling a Brisbane woman’s mobile and left multiple messages throughout the day.

The woman had missed the first call about 1.30pm and heard a man on her voicemail say “suck balls”.

The court heard Crews later left two other voicemail messages, the first saying “f--k you”.

Sergeant Lydford read to the court the full contents of the second, more graphic message.

“The other night I was sitting around playing with my balls, I really like playing with my balls and giving them a little tickle” Crews had said in the message, the court heard.

“My wife gives them a tickle, I was wondering if you wanted to come around and give them a little tickle or maybe I can shit on your face, if you like I’ll shit on your face.”

Sergeant Lydford said the victim had reported the matter to the police after receiving another five phone calls within minutes of each other.

He said Crews, a Roma based fly-in, fly-out gas worker, had later told police he’d been drinking from 1pm on May 20 and had decided to call the number thinking it was a scammer.

“He said he’d received some harassing phone call scam that day from the tax department, he thought that the number he was calling was the number he’d received that day,” Sergeant Lydford said.

“He was unable to produce any phone records confirming that.”

Crews pleaded guilty in Maroochydore Magistrates Court on Wednesday, July 21 to using a carriage service to menace, harass or cause offence.

Duty lawyer Kylie Anderson said Crews had just come back from a 14-day straight roster where he’d had “disrupted sleep” and was stressed at work.

“He has very little understanding of how these (calls) came about in the sense it’s completely out of character,” Ms Anderson said.

“He’d drunk quite a bit, he was very fatigued,” she said.

“He can’t explain how he got the number other than it must have been in his call log at some time.”

Magistrate Rodney Madsen said he accepted Crews was of good character but the victim was “distressed enough to contact the police”.

“I have no doubt he’s embarrassed, he’s a married man with children and he’s got a responsible job,” Mr Madsen said.

He said the offences were “relatively serious”.

“It’s so easy for these things to cause significant harm to people because you don’t know this victim (or) what their situation in life is,” Mr Madsen said.

Crews was given a two-year good behaviour bond, with the condition he undergoes supervision of a community corrections officer for 12 months.

If Crews breaks the bond, he will be ordered to pay $500.

No conviction was recorded.
