Caileb Wayne Kramer sentenced for Coes Creek attack

A 21-year-old told a couple he was “marking his territory” when he shook blood onto a woman and repeatedly rammed their cars during the hangover from his 21st birthday.

A man still celebrating his 21st told a couple he was “marking his territory” when he shook blood onto a woman and repeatedly rammed their cars after being triggered by a parking request.

Caileb Wayne Kramer was sentenced to a two-year prison sentence suspended for three years after he pleaded guilty in Maroochydore District Court on February 14, 2022, to seven offences.

The court heard Kramer, who celebrated his 22nd birthday on Monday by being sentenced, was drunk when he confronted a Coes Creek couple outside their house at 8.15am on February 28, 2021.

“He had a bleeding wound on his right arm and blood was dripping from his arm,” police prosecutor Alex Stark said.

“He shook his arm so blood dripped on their driveway and said that he had marked his territory.”

Mr Stark said Kramer then shook his wound towards the woman which sent blood splatter onto her arm.

The court heard the couple were screaming at Kramer to stop as he deliberately drove into the back of their Mazda that was forced up onto the kerb and hit a tree.

Mr Stark said Kramer became aggressive and tried to start a fight with the couple when the man politely declined having Kramer’s Ford parked opposite their house.

Kramer reversed twice more and rammed the car’s side and front driver’s door panel causing $12,380 worth of damage.

“He repeatedly and deliberately rammed the vehicle,” Mr Stark said.

The pair then stood in front of their new Skoda in an effort to deter Kramer from hitting it too but were forced to jump out of the way as he drove towards them.

“F---ing c---s la de dah c---s with d---s up their a---s,” Kramer said to the couple.

Police later captured Kramer 3km away from the offence location and he later blew a blood alcohol reading of 0.169.

Ms Stark said Kramer had a significant criminal history and was on parole at the time of the offending.

He suggested a prison sentence of two years.

Defence barrister Mark Dixon told the court Kramer had already spent over a year in prison and suggested a two-year prison sentence could be suspended to allow the 22-year-old to rehabilitate with help from a probation order.

Mr Dixon said Kramer had been celebrating his 21st birthday when he was taken to hospital for an arm injury in the hours leading up to the offending.

He said Kramer was given morphine and released from hospital before attending the couple’s house.

Mr Dixon said Kramer was “deeply remorseful for his actions”, had family support and had an employment offer upon his release.

Kramer pleaded guilty to common assault in a public place while adversely affected by an intoxicating substance, driving under the influence and dangerous operation of a vehicle while adversely affected by an intoxicating substance.

Judge Gary Long said Kramer’s actions in driving towards the couple and their cars was concerning.

“These people were treated in fashion that no one should ever be treated at or around their residence,” he said.

“The complainants were disturbed and concerned about all of this and screaming at you to stop.”

Mr Long said he took into account Kramer’s pleas of guilty, his young age and the fact that he had engaged in a course to address drug and alcohol abuse.

Kramer was also placed on a three-year probation order and was ordered to serve 80 hours of community service.

He was disqualified from driving for two years.

None of Kramer’s 351 days of pre-sentence custody were declared as time already served.

Once processed he will be released from Woodford Correctional Centre.
