Police will allege an Imbil flight attendant nearly punched a man holding a baby before sinking his teeth into another man’s body while yelling out he had a disease.

An Imbil flight attendant who allegedly threw a punch at a man holding a small child before biting another while yelling he had HIV has been granted bail for the “disgusting” attack.

Police allege Benjamin Duncan Herbert, 47, had been drinking heavily about 8pm on April 2 when he urinated on a tree close to a family at a picnic table in Noosaville.

Court documents say the 47-year-old was urinating in full sight of the family who had several young children, with their mother telling him to stop.

Mr Herbert replied “f--- off” according to court documents before a 61-year-old man who was holding a baby told him to move on.

Police allege Mr Herbert stopped urinating and pushed the man while he was holding the baby before taking a swing at him.

Another man jumped to their aid and tackled Mr Herbert while police were called.

Court documents say Herbert yelled out “f---” and “c---” before shouting “let me go, I’ll bite you, I have HIV”.

It’s alleged by police Mr Herbert sunk his teeth into the man’s left elbow before biting on his left shin, breaking the skin on the victim’s leg.

Mr Herbert allegedly got up and left the scene before he was found by police and arrested.

Court documents allege Mr Herbert was so tanked that he believed it was Wednesday when it was actually Saturday.

The 47-year-old flight attendant made a bid for his freedom in Maroochydore Magistrates Court on Monday charged with a slew of assault offences.

Police prosecutor David Bradley said Mr Herbert’s alleged attack was an “act of absolute public indecency” and labelled it “disgusting”.

“Biting is just beyond the pale,” Senior Sergeant Bradley said.

Duty lawyer Liesel Rogan said Mr Herbert was happy to surrender his passport and undergo alcohol testing, with the alleged offending being “out of character”.

Mr Herbert was granted bail to reappear in Maroochydore Magistrates Court on May 3, 2022.

He faces charges of public nuisance, common assault while adversely affected and serious assault with intent.

A disease test was ordered by the court.
