A married 75 year old man who was caught on CCTV footage kissing a woman without her consent has been described by his lawyer as suffering a momentary “brain malfunction”.
Caloundra Golf Club member of 30 years Adam McInniess Scott pleaded guilty to one charge of sexual assault at Caloundra Magistrates Court on Wednesday.
Police prosecutor Amanda Brewer told the court the victim was at the Caloundra Pro Golf Shop when the assault occurred.
She said Scott entered the shop at 3.35pm on December 23, 2023 when he approached the victim and “without saying a word, grabbed her with his hands on either side of her head and kissed her on the lips”.
Shocked and unsure what to do, the victim waited for Scott to leave before washing her face in the bathroom.
“The victim stated that her face and lips were covered in the defendant’s saliva,” Sergeant Johnstone said.

Reviewing the CCTV footage, police concurred the victim appeared “upset and is constantly wiping her mouth”.
The victim maintained she felt violated, disgusted and contact was completely unsolicited, Sergeant Johnstone told the court.
Representing Scott, lawyer Rowena Ferrall said her client was happily married and shared the same wedding anniversary as the victim and her husband.
“The two couples would often bump into each other when they were out for anniversary dinners,” Ms Ferrall said.
“Leading up to the event, Scott had been speaking to the complainant regularly as her husband had moved away unexpectedly and it had been very upsetting for her.
“He thought that he was comforting her and he understands that was completely incorrect.
“He didn’t mean it as a sexual advance in any way and apologises unreservedly to the complainant for his moment of madness.”
As a result of his behaviour Scott had lost the majority of his social circle and is likely to receive a ban from the club after the matter is finalised, Ms Ferrall told the court.
“His only hope is that his wife stays with him,” she said.
Magistrate Catherine Benson noted a letter of apology to the victim had been forwarded to the arresting officer.
“I have no doubt that this is behaviour that won’t be repeated by you,” she said.
“The penalty imposed is one that will not only deter you, but will also deter others in the community who would consider behaving in such a fashion.”
Scott was fined $2500 and given a 12 month no contact order.
No conviction was recorded.
