Adam James Towle-McCully denied bail over alleged Tewantin home invasion, assault

A Noosa Shire man who allegedly assaulted an elderly man after breaking into his home has shed tears during a court appearance to determine his immediate fate.

A Cooroibah man who allegedly burgled a Tewantin home before attacking a 64-year-old man who chased them with a wooden stick has been denied bail.

Police allege Adam James Towle-McCully, 27, and his 20-year-old brother Aaron Ben Towle-Cotter were discovered by the 64-year-old man inside his Tewantin home.

According to police allegations contained in court documents sighted by the Daily, the brothers attacked the man, inflicting cuts and bruises to his face.

Police say both men ran from the home with the alleged victim following them in his car down the road while holding a long wooden stick.

Police allege he found the brothers but was punched in the face through the car’s open window by one of the men.

The Tewantin man was taken to hospital for treatment of a fractured shoulder, fractured ribs and other injuries.

Both men face two counts of serious assault, enter dwelling and commit indictable offence, attempted unlawful use of a motor vehicle and wilful damage.

Mr Towle-Cotter remains on bail, while his brother fronted Maroochydore Magistrates Court on August 18, 2022 in a bid for freedom.

His solicitor, Matthew Cooper, said his client had “significant ties to the Sunshine Coast” and could adhere to a “complete curfew” if granted bail.

The court heard Mr Towle-McCully had been allegedly assaulted during his time in jail.

Mr Cooper said his client could be facing “significant delay” before he’s ultimately sentenced for the alleged offences.

Police prosecutor Sergeant Nick Nitschke objected to the bail application, stating the community “deserves protection” from alleged offenders like Mr Towle-McCully.

Sergeant Nitschke said Mr Towle-McCully, who was on bail for separate offences at the time of the alleged offending, should remain in custody.

“He’s shown not only through his conduct and his history he doesn't have a great regard for conditions of the court imposed on him,” he said.

Appearing to clutch his hands in prayer on the video link, Mr Towle-McCully was denied bail by Magistrate Haydn Stjernqvist on Thursday, sparking tears from Mr Towle-McCully.

The matter was adjourned to September 19, 2022, for mention.

Mr Towle-Cotter’s matters are set down for mention on September 2, 2022.
