Accused murderer James John Neale’s matter mentioned in Maroochydore court.

Fresh details regarding the case of an accused murderer who allegedly stabbed his uncle to death and was shot by a police officer west of Gympie have been revealed.

A man who has been accused of stabbing his uncle to death in a small town west of Gympie had his matter mentioned in a Sunshine Coast Court.

James John Neale was represented by defence lawyer Shane McDowell when his charges of murder and seriously assaulting a police officer while armed were mentioned in the Maroochydore Magistrates Court on May 17.

Mr Neale did not appear in court.

He was charged on May 15 after his uncle Paul Mann, 55, died at a Kilkivan property, about 50km west of Gympie, on April 12.

Police previously alleged Mr Mann was stabbed by his nephew.

Officers had rushed to the Running Creek Rd about 3pm following reports of a family dispute.

Police alleged an officer had no choice but to fire his gun at Mr Neale, who allegedly ran toward the officer, causing him a chest wound.

Mr McDowell asked for the matter to be moved to Gympie Magistrates Court during the committal mention in Maroochydore court.

Police prosecutor Jeanette Grigoris said no brief of evidence had been completed yet by arresting officers.

Magistrate Matthew McLaughlin deliberated whether to adjourn the matter for several months considering the charge, rather than the standard two weeks.

He adjourned the matter to July 15 at Gympie Magistrates Court.
