Nicholas Pozzebon’s court proceedings delayed over co-accused’s directions hearing

An alleged member of a bikie gang must wait for his next steps in court after he was accused of a role in a highway car chase and attack.

Documents regarding an alleged bikie gang member charged over his alleged involvement in a car chase and bashing have yet to be signed by the Office of Public Prosecutions.

Nicholas William Pozzebon had his matter called in the Maroochydore Magistrates Court on May 26, which defence lawyer Caprice Gobie-Smith spoke to on his behalf.

Mr Pozzebon faces several charges following his alleged involvement in an incident on September 18, 2024 alongside two other co-accused, Nathan Peter John Dyson and Matthew James McKenzie.

Court documents previously viewed by this publication alleged Mr McKenzie was an “associate” of the Rebels OMCG gang and Mr Pozzebon and Mr Dyson were “patched” members.

It is alleged Mr McKenzie had a falling out with the alleged victim over an investment, which spurred a chase along the Bruce Hwy between the alleged victim and a Ford Ranger, driven by Mr Dyson.

The two cars were then joined by a Dodge RAM driven by Mr Pozzebon with Mr McKenzie in the backseat, which rammed the alleged victim’s car into an emergency stopping lane, it is alleged.

After travelling towards the Harmony Estate in Palmview, the RAM then allegedly collided with the alleged victim’s car, causing the vehicles to crash.

It is alleged Mr Pozzebon and Mr Dyson then pulled the man out of the vehicle and repeatedly punched and kicked him, while Mr McKenzie acted as a lookout.

In court on May 26, Ms Caprice Gobie-Smith said paperwork for a registry committal for Mr Pozzebon had been sent to prosecutions, who had “resisted” signing the documents.

Police prosecutor Tara Miles told the court Mr Pozzebon’s co-accused, Mr Dyson, had a directions hearing on July 9 and prosecutions would prefer for both matters to move to the higher courts at the same time.

Magistrate Chris Callaghan adjourned Mr Pozzebon’s matter to July 9, to coincide with the directions hearing.

The trio has been charged with assault occasioning bodily harm (serious organised crime), operating a vehicle dangerously and endangering the safety of a person in a vehicle with intent.

Mr Pozzebon is also charged with driving whilst a drug is present in his system.

No pleas have been entered and Mr Pozzebon is on Supreme Court bail.
