A Nambour boat builder was “emotionally-charged” when he physically assaulted his pregnant partner before a doctor’s appointment for their unborn baby, a court has heard.

Mitchell Louis Grams, now 29, was given six months’ jail to be suspended for 12 months in Maroochydore District Court after pleading guilty to one count of assault occasioning bodily harm on September 28, 2022.

The court heard Grams was at Cooroy on March 31 when he got into an argument with his then-partner who was eight weeks’ pregnant with his baby.

The court heard the pair were both “emotional” and “stressed” at the time as they were having pregnancy complications and had a doctor appointment booked that day.

Judge Suzanne Sheridan said the dispute escalated into a physical altercation when Grams grabbed hold of the woman’s arms and held her with such force that he caused welts and scratches that broke her skin on her arm, shoulder and back.

“You then pinned the complainant down on the bed using your body weight, the complainant was struggling to breathe and was yelling,” Judge Sheridan said.

“The complainant managed to hit you on the nose and your offending stopped.”

The police were called and caught Grams on his way out who later stated he was trying to protect his then-partner.

The court heard Grams had a criminal history of low-level offending.

Defence barrister Simon Lewis said Grams had lived on the Sunshine Coast his entire life and completed up to Year 10 at high school.

Mr Lewis told the court his client was previously working as a boat builder but had to cease work to be able to comply with his bail reporting.

“He’s now working at the Boat House in Noosa as a kitchen hand,” Mr Lewis said.

“He accepts that he should have dealt with the matter in a different way.”

The court heard Mr Lewis hoped to return to boat building and had been diagnosed with ADHD which he was working to manage.

A conviction was recorded.
