Kitesurfing instructor in Maroochydore court for indecent treatment charges

A Sunshine Coast kitesurfing instructor is set to face trial after he was charged with indecent treatment of a child under the age of 12.

A Sunshine Coast kitesurfing instructor has been charged with indecent treatment of a child under 12 and will face a trial in the coming months.

The incident treatment was allegedly committed by a man in his 60s in early 2003 when the child was aged under 12-years-old.

A complaint was made to police in December 2018, with the complainant providing a written statement to police in January 2019.

Since then there had been several pre-trial procedures undertaken by the accused, including an application to access Protected Counselling Communication (PCC).

The documents sought by the accused related to psychological counselling undertaken by the complainant.

On February 5, 2021, Judge Glen Cash ordered the application be dismissed.

The accused reopened the application in 2022, but it was once again dismissed by Judge Cash on June 18.

“Even if there is a conclusion that the allegations were discussed, it remains the case that the applicant can point to no reasonable basis for a conclusion that the discussion will contain inconsistencies or other statements of such a nature as to be substantially probative at his trial,” Mr Cash told the court.

“I’m therefore not satisfied that there is special reason for reopening my ruling in February of 2021.”

Court documents revealed the accused was employed as a kitesurfing instructor and was residing on the Sunshine Coast.

He is set to face a District Court trial later this year.
