Daniel Peter Toomey in court for possessing knife, damaging police van

A man who flicked around a butterfly knife on a major Sunshine Coast road causing bypassers fear had months prior inadvertently trapped himself in a police prison van when he became violent.

A man who walked down a major road in Maroochydore brandishing a butterfly knife has learned his fate before court.

Daniel Peter Toomey appeared in Maroochydore Magistrates Court on July 10 and pleaded guilty to possessing a weapon and wilful damage of police property.

Police prosecutor Mel Pyke told the court police had received reports of a man roaming Aerodrome Rd with a knife in hand on April 26, 2024.

Toomey was located by police and he admitted he was in possession of a knife.

The court heard Toomey had damaged police property when he became violent whilst being transported in a prison van on February 15, 2024.

Sergeant Pyke said the van was unable to be opened after Toomey kicked at the door and broke the lock.

Officers had to stop at a police station for power tools to open the van, the court heard.

Defence lawyer Neesha Maidwell told the court Toomey had recently found the knife prior to the incident.

She said Toomey had been “flicking” the butterfly knife open and closed.

Magistrate Rod Madsen noted the incident occured only two weeks after Toomey was released on parole for separate matters.

He sentenced him to one month of imprisonment wholly suspended for six months taking into account he had spent 30 days in custody prior to his sentencing.
