Benjamin Tynan Drake-Brockman guilty of threatening violence in Cornerstone Pub

A man labelled a “pest” by a magistrate after threatening a bar manager during a night out has pleaded guilty to several offences in the Maroochydore Magistrates Court.

A man who stopped taking his bipolar medication before threatening a bar manager at a Noosa pub has been labelled a “pest” by a magistrate and sentenced to six months’ jail.

Benjamin Tynan Drake-Brockman, 37, of Noosaville pleaded guilty to several charges in Maroochydore Magistrates Court on August 8, 2022.

On May 31, 2022, Drake-Brockman was at the Cornerstone Pub in Noosa Heads when he was asked to leave several times.

The court heard he formed his hand into the shape of a gun and pointed it to the head of a bar manager.

He was also asked to leave Nomads Backpackers on that same night and was breaching bail by entering licensed venues in the Noosa entertainment precinct.

For the May 31 offences, Drake-Brockman pleaded guilty to four counts of breaching bail, two counts of failing to leave the Cornerstone Pub, a public nuisance offence and threatening violence at night.

The defendant also pleaded guilty to other offences committed in May.

Police prosecutor Stephen Potter said the threat of violence towards the bar manager was the most significant charge Drake-Brockman faced and the offences were committed during a probation period for similar matters.

Solicitor Chantelle Allen said the reason the defendant kept returning to Nomads was that he had started a relationship with a woman staying there and kept going back there to see her even though he was asked to leave.

She said Drake-Brockman had a history of bipolar disorder, manic-depressive disorder and anxiety and he decided to come off medication in Christmas, 2021 and Easter, 2022.

The solicitor said the defendant was also couchsurfing and started drinking heavily at the time of the offences.

Ms Allen said Drake-Brockman had already served 69 days in presentence custody.

She tendered letters from psychologists and a work reference that showed he would be re-employed at a lawn maintenance company upon his release from jail.

Magistrate Christopher Callaghan said the defendant had to stay on his medication.

“You’re a pest,” he said.

“Yes I take into account your medical conditions, your psychiatric conditions … when untreated you behave in a manner that is not how we or members of the community can behave.”

Drake-Brockman was sentenced to six months’ prison and the magistrate took into account the time already served.

He was released on parole on August 8, 2022.
