A court has heard of a 35-year-old man’s 10-year drug addiction as he was sent to jail for supplying an eight-ball of meth.
Benjamin James Fischer pleaded guilty on June 8, 2023 in Maroochydore District Court to one count of supplying meth and one of supplying butanediol at Twin Waters.
Judge Glen Cash said he sold or supplied an “eight-ball” or 3.5g of meth and 10mL of butanediol
The court heard the offences occurred on February 27 and 28, 2022 but were only exposed in October, 2022 as part of police investigations in another matter.
The court heard police officers discovered messages on another man’s seized phone revealing Fischer had supplied him meth and butanediol across two days.
He was released on parole on September 2, 2022 after he was sentenced to 15 months’ imprisonment in Caloundra Magistrates Court for 24 offences on July 14, 2022.
Fischer’s parole was suspended on May 25, 2023 for unrelated allegations, the crown prosecutor told the court.
He is currently on remand for these matters.
Defence barrister Lachlan Ygoa-McKeown told the court Fischer worked as a pool builder in a family business alongside his brother and father.
“He was in his mid-20s after his separation from his then-fiancee, that he first tried substances to the extent he then developed a dependency,” Mr Ygoa-McKeown said.
Mr Ygoa-McKeown said Fischer has since struggled in those 10 years with a drug addiction, and the offences occurred “within the context” of that addiction.
“Also at that time, he was associating quite heavily with other drug-users,” he said.
After he was released on parole in September, he was “doing somewhat well” abstaining but relapsed while coming back in contact with previous associates, Mr Ygoa-McKeown said.
Judge Cash said it was critical for Fischer to get help in drug diversion courses.
“Getting on top of your addiction is the key to your future,” he said.
Fischer intends to move north with his brother to continue working in the pool building industry.
He was sentenced to nine months’ imprisonment to be released on parole on August 8, 2023.
