A 50-year-old man busteed driving while nearly three times the legal alcohol limit has avoided jail despite fleeing cops at a Stanthorpe RBT and running into dense bushland.

Police prosecutor Steve de Lissa told the Stanthorpe Magistrates Court Shane Fredrick Dolan’s spree of nine offences ran from April last year to February.

Sergeant de Lissa said police found a stolen Medicare card in Dolan’s trouser pocket int he early hours on April 24 last year.

The 50-year-old at the time claimed his bad eyesight fooled him into thinking the Medicare card was his.

Sergeant de Lissa said police busted Dolan drug driving on the New England Highway at 7.50am on August 12, where he returned a positive reading to meth.

Police also found the father of two with a used syringe in his front jumper pocket on October 21, which he claimed he didn’t know was there.

Sergeant de Lissa said Dolan was waived to pull into a High Street RBT site by police on February 12.

“(Dolan) pulled in and then accelerated away where police followed him, to where he had pulled into nearby bushland and ran from the police vehicle,” he said.

Police later caught Dolan where he returned a blood alcohol concentration of 0.122.

Defence lawyer Amber Acreman said her client had turned his life around since falling ill with septicemia in January, after injecting himself with a dirty needle.

“My client has been clean from drugs for over 150 days,” she said.

Magistrate Julian Noud told Dolan that if he continued to abuse drugs and did not get on top of his addiction, it would kill him.

The Woombye man pleaded guilty to one count each of drink driving, drug driving while on a provisional licence, failing to stop, possessing tainted property, breaching bail, and failing to dispose of needles and syringe. He also pleaded guilty to three counts of failing to appear.

Dolan was sentenced to three months but released on immediate parole.

He was fined $1450 and disqualified from driving for four months.
