Kenneth Day court case delayed until 2026 as lawyers await evidence

A 67-year-old former Cherbourg State School aide faces serious child sex charges, but won’t return to court until March 2026.

A serious child sex offences case against a South Burnett community leader and teaching assistant has been delayed.

Kenneth William Day, 67, has been charged with 12 charges related to alleged child sexual abuse in June.

The charges include four counts of rape and eight counts of indecent treatment of a child under 12 years, allegedly committed against three different children over the span of several years.

This publication understands that Mr Day worked as a teacher’s aid at Cherbourg State School for many years, and had been appointed as a member of the elders advisory council shortly before he was charged.

Mr Day’s lawyer Mark Werner told Murgon Magistrates Court on Tuesday his legal team was waiting to receive all the evidence related to the charges.

Mr Werner said they had received the initial brief of evidence but were awaiting further disclosure material and requested a lengthy adjournment.

Mr Day did not appear in person in Murgon Magistrates Court on Tuesday, December 9.

Magistrate Andrew Sinclair adjourned the matter until March 17, 2026, when it is due back in Murgon Magistrates Court.
